Customer Terms and Conditions

  1. “Mr Smith Photography” refers to it’s lessees, contractors or subcontractors, employees, agents or servants. If any portion of the following terms should be determined to be invalid, it is agreed that the validity of such portion shall not affect the validity of the remaining portions.
  2. All original images whether on film or electronic medium belong to Mr Smith Photography. As the person(s) commissioning the photography, I agree that Mr Smith Photography may publish or exhibit the photographs or enter them into competitions at its sole discretion.
  3. The commissioning client is given a license to only make use of released images for personal and non-commercial use.
  4. I assume all responsibility for obtaining any necessary permission, clearance permits or admission fees which may be required for Mr Smith Photography to fulfil this contract.
  5. To secure the booking a non-refundable deposit of $200 is required for wedding related services. Prices are inclusive of G.S.T.
  6. Downgrading of packages shall result in the price difference forfeited.
  7. Cancellation within two weeks of the proposed day of service in the case of wedding related services shall result in the mandatory payment of 50% of the contract. Cancelation within 24 hours of the proposed day of service in the case of portraiture related services shall result in the mandatory payment of 100% of the contract.
  8. Upon the completion of the commissioned photography, all outstanding monies shall be paid in full.
  9. Mr Smith Photography cannot be held responsible for any specific image that may not be delivered. I acknowledge and understand that Mr Smith Photography uses a highly stylized and photojournalistic approach to weddings, with few pre arranged or posed shots. Any failure by Mr Smith Photography to deliver any specific image shall not be a breach of contract, shall not result in a refund of any monies paid to Mr Smith Photography, nor a deduction of outstanding payments.
  10. Mr Smith Photography takes the utmost care with the production and delivery of the commissioned work. However, in the event that Mr Smith Photography fails to comply with terms of the contract due to any event or act which prevents the delivery of the commissioned work, Mr Smith Photography’s liability shall be limited solely to a refund of any or all monies I have paid to Mr Smith Photography, and my sole remedy shall be receiving a refund of any or all monies I have paid to  Mr Smith Photography.
  11. If for any reason Mr Smith Photography is unable to perform the prescribed services,  Mr Smith Photography will make every reasonable effort to recommend and secure replacement personnel. Requests for particular personnel will be met where possible but are not guaranteed.
  12. Mr Smith Photography is hired on the basis of being the only photographer for the day and reserves the right to terminate all services if another photographer/videographer (professional or otherwise) interferes with Mr Smith Photography’s ability to work without impediment.
  13. Mr Smith Photography reserves the right to suspend its services if it is deemed that the health and safety of Mr Smith Photography personnel or equipment is at risk. Although Mr Smith Photography accommodates most weather conditions, excessive rain could damage both camera and lighting, certain exterior photography may be compromised.
  14. If any of Mr Smith Photography’s equipment is damaged beyond normal wear and tear due to malicious acts or negligence by the client or by other attendee of the event in their possession, I agree to pay for any and all repairs or replacement charges.
  15. Photos produced are delivered via Dropbox.com or on USB, canvas or acrylic,  Mr Smith Photography does not and cannot guarantee the longevity of the products due to normal wear and tear or due to the nature of physics. I am responsible for their safe-keeping and longevity.
  16. Mr Smith Photography uses new memory cards and hard drives in good working order. However Mr Smith Photography cannot be responsible foe manufacturer’s faults and any loss or damage resulting from camera failure, computer failure or transfer error.
  17. In the unlikely event that Mr Smith Photography is required to file legal action to collect fees due from myself under this contract, or to otherwise enforce this contract, then Mr Smith Photography shall be entitled to recover all costs and expenses incurred in relation to such legal action.
  18. The commissioning client is required to pay travel expenses at Mr Smith Photography’s sole discretion. The packages include allowance for up to $10 in parking and toll fees. Any additional parking or toll fees will be charged to me at collection of the prescribed products.                                                                   
  19. Mr Smith Photography’s personnel has a vehicle for transport on the day, however if special transport is needed (such as a water taxi), this is to be organized and paid for prior the wedding by myself.
  20. In the event that products are to be posted, I am required to pay postage & handling fees.
  21. I agree to abide by any or all of Mr Smith Photography’s policies with respect to time-lines and other such aspects to aide Mr Smith Photography in the deliverance of its work. My failure to deliver on time, including to but not limited to, booking sheet, monies, photos, editing instructions, will hinder Mr Smith Photography’s ability to perform its job, and they shall not be liable for any resulting delays or inability to deliver.
